To tell the truth it sends shivers down my spine whenever I am reading, writing or talking about it. I am talking here of the most beastly of all crimes against humanity. In fact even beastly is an understatement. Have you guessed it right?

Justice Arjit Pasayat had aptly remarked once, “While a murderer destroys the physical frame of the victim, a rapist degrades and defiles the soul of a helpless female."

Going by what he said rape becomes a bigger crime than murder. And therefore if there is death or life sentence for murder, then for rape what should it be?

And then here we have people from various walks of life who even raise slogans against death penalty to rapists. The sound logic they give is that capital punishment will not solve the problem. It may in fact lead to the murder of the victim. And they advocate the need for stringent application of existing laws than otherwise.

Agreed capital punishment is no solution. Neither to rape nor to murder or for that matter any other crime. However it in some cases may act as a deterrent. Maybe that is what made L K Advani raise the issue in Parliament once. And perhaps the reason why it ebbed as fast as it had picked up fervour was due to the apparent callousness of whom the society calls women’s rights activists.

One question does strike the mind. There could be a loophole in giving capital punishment to rapists. But where is the law without one then? Agreed there is life involved here. But there is life involved even when a woman loses her life to a gender crime?

Where is the same furore whenever any woman or girl is raped? Talk of death penalty to rapists, then all are up in arms. Is the life of a suspected criminal overrated compared to that of a hapless rape victim? Or is the plight of the victim underrated?

Is the stress more on understanding the mind of the criminal and less the mind of the victim after she is subjected to this should I say torture or do you have a stronger word?

The real need is to finish this deplorable crime. A preventive mechanism is needed. Italy just passed an emergency rape law. The law stipulates death for minor’s rape and for rape-cum-murder cases. It also talks of street patrolling by unarmed retired soldiers and cops who’ll be well equipped with mobiles and radios. This is a well-thought out step since it tries to negate the possibility of the crime rather than acting after the crime is done.

After the gruesome act is committed, scars remain forever and prevent one from leading a normal life. So easy for persons like me and you who are used to living normal lives, to assert a no to death penalty. Agreed a rapist too needs help. But tell me which criminal doesn’t?

Another argument is why not life imprisonment? Why death penalty? Well, the answer is just waiting to be told. In the under-developed and the developing nations like our own, the prison system is not methodical enough that’ll ensure that the convict is behind bars forever. Also on account of his “supposedly” good behaviour, he may once again run scot-free….

Why take a chance?

The victim is ruined physically, mentally and psychologically. No need to go through any laws for that. One law will be enough. Break your own silence to this crime. Ask yourself: “Have I become immune to it? Has the frequency of this gory evil increased manifold?” You will find the answer.

Also ask yourself, “Do I want to make the society I live in safe for my mom, sister, daughter and myself?” Here too you will find the same answer.

Well then join hands in the fight. Together we can stand to destroy this crime.

Any one want to write on this matter write to shiv_sr5@yahoo.co.in : Can u define what is rape? A cpuple living together and enjoying their life (including sex as Living relation) for few year and suddenly girl come up and blaming that man rape for years. Is it rape? Can you tell how to stop such incident? Normal people are spiting on Hindu`s way of life who also teach `` brahmcharya``. I ask one thing the increase in crime ( Rape, Thept, Murder etc) is effect of moral degradation of human being. One side u are egniting sexual behaviour of human being by movies, addv, gay right etc and at the same time u are crying for rape. Is it not like writing ``Injurious to health`` at lebal of cigrate and wine and earning money from their marketing????? I have lot of question to ask and discuss. Please write to us the blog writer

Can you tell what law should do in situation like that. A girl and boy live and enjoy sex life together without marrige some day. After some day girl come up and say that the boy has raped fo so many years? Can you tell me how to stop the incident of rape before happening? Any can suggest me.

we can follow harsh laws of different countries as suggested by bloggers.but wt if women has filed a false case.in india,by default women`s are considered to be truthful.as the womens have got developed they have walked in various fields and became successful but they have also made thier mark in crime.there have been many cases in which women has murdered or been involved in nasty crimes.im not sure the other countries have same suituation where we consider women truthful by default.A man needs to be tried unpartially and then should decide punishment.also there should be same punishmentt for women who has filed false case against which the man wud have recieved if he had raped her truly...same punishment..thts hw we can reduce false complaints

The first and foremost thing to do with a rapist is, castrate him so decisively, that he simply doesn`t get an erection for the rest of his lifetime. This could be a perfect initial punishment for any rapist. And the rapist should be subject to this punishment, the moment he confesses his crime, or conlusive evidence is obtained in the same regard.

Follow Singapore Law. It is basically follow British or Indian Law system but modified for Raping Crimes.The person will be given Three Strokes which give a permanent Scar to him and put him in Jail. Also they publish in Newspaper with his photo and Stroke Scars. The Stroke is generally very painful and the Scar gives alert to another girl or Woman to whom he wants to have Sex. I belive there is a fear phobia created due to this.

Death penalty will not remove the crime of rape in India. The first issue to tackle is the skewed sex ratio. Female infanticide needs to be curbed. As one can see the situation in Haryana where rape cases have increased in direct proportion to falling female population. The second issue that needs to be addressed is gender discrimination in the name of culture and Indian tradition. Currently women subjugation is promoted by the patriarchal system entenched in our society. The so called Indian version of victorian norms that we so gladly aped from the British rulers are still prevelant and had evolved into something more sinister. We just have to look back into our history before the moslem invasions and rule how free our society was for women. The third issue is female illiteracy which we havent been able to eradicate. Women empowerment continues to be a distant dream. As long as a patriarchal society is supported discrimination against women will continue and rapes will happen. lastly the judicial system again is designed to favor men, infact it is men who made the laws. I cannot recall any woman associated with our judicial system. Whereas the police investigation involved in rape cases we still lag behind in forensic investigations. I dont think our country has the money or infrastructure to handle all rape cases based on DNA evidence. I am sure 99 of the police force is not equipped with a task force handling such cases on the basis of a proper scientific criminal investigation that involves forensic science. One has to look at some of the rape cases that happened in Goa.

Don`t compare with other countries, there is lot of corruption in the law and order system in India and people may use this to avenge their personal enemities. We can have capital punishments in those places where the trials are done fairly and the system is not as corrupt. What if the person is not guilty but the circumstances are against him? There were many cases in US also where capital punishment was carried out but later there were evidences that the person who was uted was innocent. Can you imagine what happened to their families?

There is a basic misunderstanding about crime and punishment. As much as the other person does not have any rights over your body and soul, you do not have any right over the body and soul of the other person. We punish not to avenge but to prevent. But most of the times in history and modern times it is treated as compensation for the victim. The most we can do is say that the person does not belong to the society and keep them secluded. The duration should not depend on the crime but the person who commited the crime. Even for a small crime if the person repeatedly commits it then not point letting him live among comon people. But if the person has some hope of changing, which will not be the case of rapists, than the term should be short. But we can not play god. We cannot give life to a dead person so we can not take life. Whatever may be the crime. What right do we have to take his life? Though we have the right to deny him a place in our society.

Well I am an Indian working here in Singapore for the last 3 years now and have learnt many things from this place. Singapore is very strict when dealing with crimes against women. The most simple punishment for eff-teasing is 4 lashes and that to rape may amount to death punishment. I belive I am very happy with this laws here, me and my wife feel safe when we roam at night. This is the reason the country is clean of violence, rape, murder. If a country small as Singapore can have these laws why cant India. Oooh, yes I forgot the Human Rights. This is the worst thing I have ever heard. I mean what does it do, does it give employment to the unemployed? Or feed the hundred thousands hungry kids? All its busy with saving the criminals from getting punished. I dont support death punishment too, but I also believe that human feelings should be kept for humans and not for these psychos who are a disgrace to the human kind.What does life imprisonment, a punishment? What kind of punishment is that, living in a jail having free meal 4 times a day and earning some money moving around carefree. We are the tax payers and our taxes goes into feeding these rapists and murderers. In fact it can be said, the father of the rape victim is feeding 4 times a day to his own daughter`s rapists. I mean isnt that fantastic. This is no world for showing mercy to inhumans. They should be punished to death.

Crazy comments .....this is not saudi arab....then if u talk about cutting the manly part..thn also introduce harsh laws for murder and injur..an eye for an eye ....a hand for a hand....does our society dare to accept harsh laws in all crimes...why only for rape...a crime is a crime.if u wanna follow the muslim countries style punishment....this is juss taliban thinking..like they chop the head of people who speak against them...our generous society will never accept eye for an eye rule ..so why chopping man part for raping...a death sentence might be the most harsh option we cud use...

Rape- Its not just a crime against a body, its a crime against a soul the soul of the victim. I believe that rape is more than a capital crime and hence capital punishment seems too lenient to the rapist. The criminal should be subjected to the same kind of mental trauma as the victim undergoes over years, only then can we give justice to all those affected individuals. Certainly, prevention is better than cure. Incidents of rape are less common in North America and Europe, with the obvious reason of literacy and less sexual frustration, which can further be attributed to the freedom of sex. To make the society free of such heinous offense, we need to abandon conservatism. Developing countries, like India, are on the path to westernization. We are adapting Western fashion, life style, dances etc., but fail to learn something more crucial than that. We need to realize that the countries like the US and the UK provide a proper vent for sexual desires, which in turn frees the society from at least this soul-devastating crime.

People who involves and proved guilty in these kinds of beastly crimes should not be sentenced to death.They should be treated properly as a part of the society and they should be given the right to stay in the society BUT BEFORE THAT HIS MANLY ORGAN SHOULD BE CHOPPED OFF.They should be tied with an iron rope in PUBLIC PLACES (OPEN JAILS) UNDER A SIGH BOARD DISPLAYING THERE SHAMEFUL ACT AND SHOULD ONLY BE GIVEN ONE TIME MEAL.THIS WILL ACTUALLY MAKE THEM REALIZE THAT HOW DOES IT FEELS WHEN SOMEBODY DESTROYS THEM PHYSICALLY AND MENTALLY AND ITWILL LEAVE A MESSAGE IN THE SOCIETY THAT LAW DOES EXISTS.

I really agree what Mr. Prashant from Pune said. Instead of giving capital punishment where we can see that this crime is increasing day-by-day out and within family. so, if the main part is cut off, with this shame, no crime will take place and no job should be given to this rapist and for his family. In this, why this crime will be reduce. But who will tell the government. All the politician are fighting for their own seat. We all people come together, join hand-in-hand and fight so that no girls, children or woman face this problem.

The first thing to be done is to alter the attitude of the public towards rapists as well as rape victims. We should see to it that a rapist gets shunned by everyone in the society (even by opportunistic political parties since politics is generally regarded as the last resort of scoundrels!). We have to create such a situation where a rapist will not be able to find a job to sustain him and his family. All his credentials should be confiscated. There should be no sympathy shown in this regard. This punishment will be more severe on him compared to any capital punishment since he will have to live the rest of his life losing his social standing and dignity. Along with this, the society has to learn to look at a rape victim sympathetically. We should stop taunting a rape victim. I am no woman but I strongly feel that it is the attitude of the general public towards a rape victim that hurts more than the degradation caused by the rape itself. We also need a more scientific approach in that, a clear understanding of the rapists psychology may help reduce incidents of rape.

This may sound harsh, rude and non-social but my suggestion is such person should be punished in such a way that he is never able to commit such crime in future and only option is to trim the body part which is responsible for such hated act. Exactly like the old saying ``Naa rahega baans naa bajegi bansuri``, other than that he should be kept in prison for whatever time our law agrees.
