Los Angeles: "Modern Family" star Sofia Vergara has dismissed her ex-fiance Nick Leob's claims that she refused to protect a pair of frozen embryos, they created while they were engaged.

"The claims made against Sofia Vergara by Nick Loeb are incredible and have no merit. Vergara has never wanted to destroy her embryos," the actress' lawyer Fred Silberberg said in a statement.

Loeb, 39, filed a lawsuit against Vergara, 42, to save two cryo-preserved female embryos which they created through in vitro fertilization while still together. The couple split up last May, reported People magazine.

According to court documents, he sued Vergara in August 2014 to "ensure that the female embryos" are kept safe, because she "refuses to agree to their preservation under all circumstances." The couple split last May.

Vergara's lawyer countered that the former couple signed an agreement in November 2013 at the time the embryos were created, which stated that "no unilateral action can be taken with regard to the embryos unless both parties consent."

"She has always maintained that they be kept frozen, a fact which Loeb and his counsel have always been aware, despite Loeb's statements to the contrary.

Vergara, who has happily moved on with her life, is content to leave the embryos frozen indefinitely as she has no desire to have children with her ex, which should be understandable given the circumstances," the lawyer said.
