New Delhi: The fate of two men, who were
termed as Al-Badr terror group militants by the Delhi Police
but were later given a clean chit by CBI, still hangs in
balance as the case relating to them was adjourned in a Delhi
court on Monday.

Additional Sessions Judge S K Gautam, who was directed by
the Delhi High Court to reconsider the plea of the accused for
discharge following the findings of CBI`s closure report
against them, was on leave.

The matter against the duo was adjourned for October one.

The High Court had on August 28 referred the matter back
to the trial court directing it to consider CBI`s report.

It had said the trial court will decide the matter on the
basis of findings of CBI`s closure report without being
influenced by the chargesheet filed against them by the Delhi
police.

Irshad Ali and Moarif Qamar were arrested by the Special
Cell of Delhi police in 2006 on suspicion of being Al-Badr
militants in alleged possession of arms and ammunition.

The duo alleged frame-up, prompting the High Court to
direct a CBI probe which held them as innocent and recommended
action against three police officers for implicating them.

The duo claimed they were acting as Intelligence Bureau`s
informers and the Delhi Police had picked them up from Dhaula
Kuan area of Delhi on December 12, 2005.

Their arrest was formally shown on the day when a notice
of their being missing was published in a newspaper on
February 9, 2006, following a complaint lodged with Bhajanpura
police station by their family members.
