Delhi gang-rape: Sixth accused a minor, rules Juvenile Board

New Delhi: In an important development in the Delhi gang-rape case, the Juvenile Justice Board on Monday ruled that the sixth accused in the December 16 incident is a juvenile.

Rejecting a plea seeking that the sixth accused in the horrific rape case be subjected to bone ossification test to medically verify his age, the court accepted his age as per the date of birth mentioned in the school certificate submitted by principal of his school.

According to the birth certificate, he was born on June 04, 1995, which means he was 17-year-6 month-11-day-old on December 16, when he committed the crime.

"He is a juvenile. The Juvenile Justice Board declared the sixth accused as juvenile on the basis of the date of birth on his school certificate which mentions June 04, 1995," said prosecutor Ishkaran Singh Bhandari after the hearing before the board.

The accused would turn 18 in June, he said.

The sixth accused is alleged to have played the most violent role in the whole incident.

As per the law, bone test is conducted only in the absence of the school certificate. In this case, as the certificate has been furnished, it will be taken as final.

The petitioners now plan to move the higher court.

It is shame. A juvenile commits a most horrific act and he will be free in a couple of months! Shame on the justice system in India. Also shame on the ministries and other organizations who opposed the lowering the age. This is another black day for India.

The petitioners should move the higher argument. They should garner all possible facts and arguments to fit the current legal requirements (not ignoring that there have been ministerial assurances of toughening the existing rape laws). there are millions of youth in the age group 15-17 of whom a sizable proportion is threat as potential rapists, when half a chance to vent out their baser beastly urges presents itself. considering this colossal number, which is on account of that may be called the ``democraphic penalties`` of our population growth pattern, it is absurd to discriminate them concessionally in the rape laws which after significant modification. This proportion may even be increasing due to the easy susceptibility of the young to corruptive influences of the rapid decline in our moral standards from various sources.

In India the Legal Age to Keep a Child as a Labor is 14yrs den Why is a Rapist who is 17yrs Old Considered as a Child? Indian law is used as per Convenience. Bachho se Kaam karwao toh 14yrs se Bade Bachhe, Bachhe Nahi. Crime kare toh???? Change the definition of minor. Punish the rapist juvenile. i suggest 18 year olds are not ``Nadaan`` anymore..

The Hon`ble Board has rightly relied upon the school certificate of the juvenile. although he is accused of a serious crime he must be given the benefit of juvenile justice act and on his conviction he may be kept in special home for correctional purposes. reformation is more important and effective than deterrence. Let the juvenile be reformed and repent his acts when he becomes major. although i don`t support such crimes but as a juvenile he must be given a chance to live in the main stream of the society after his reformation in the correctional home.

1. The nature of the crime should be taken into the consideration. 2. The jevenile age should be fixed at 12 as this is age when person is capable of commit any kind of crime as per records available.

The case of Delhi gangrape is turning one of the most pivotal in the history of India. .... So many shortcomings of the Indian system - judicial, law-enforcement, utive, medical, cultural are being exposed. ... Somehow I believe god designed this case so that these aspects could be highlighted and subsequently repaired. .... now consider the huge controversy this juvenile aspect will create..... The most vicious of perpetrator will get `counselling of not more than 3 years` thanks to a 6 month period.... on the contraray if he was 6 months older, he would surely be hanged..... thus poorly designed laws can make a difference betweenn `counselling vs. death`

hm... congrats poor `child`! your world has been wicked to you, but there is no reason your revenge be directed at one who had nothing to do with you. Not fair. One thinks, the `bone test` is best confined to dead historical stuff/ fossils/ archeaology and related areas. Better served there. Surely there is an exception to every rule.. which should be considered here. With so much `venom` in the `young man`, what guarantee he will not do it again, if this is not his debut act?
