Delhi HC notice to KV Sangathan for denying admission to boy

The Delhi High Court on Tuesday sought a response from the Kendriya Vidyalaya Sangathan for denying a 7-year-old child admission in Class I in academic year 2010-2011 on the alleged ground of overage.

a response from the Kendriya Vidyalaya Sangathan for denying a
7-year-old child admission in Class I in academic year
2010-2011 on the alleged ground of overage.

Justice Kailash Gambhir issued a notice to the Principal,
Kendriya Vidyalaya, A.A.I. Rangpuri and sought a reply by May
6 on a petition filed by Aman Kumar Chaudhary alleging he was
overage by 1 month 2 days over 7 years as on 31.03.2010 and
the school denied him admission in Class I.

His counsel Ashok Aggarwal said fixing maximum age for
admission in Class I in its schools was against the guidelines
for admission in Kendriya Vidyalays.

Aggarwal also termed the decision as unconstitutional,
arbitrary, discriminatory, violative of the Constitution of
India and contrary to the Right of Children to Free and
Compulsory Education Act, 2009 and violative of Delhi School
Education Act, 1973.

According to the petitioner, his father had applied for
Aman`s admission in class-I in Kendriya Vidyalaya, Rangpuri,
for academic year 2010-2011 on 8.03.2010.

On 22.03.2010, the school displayed the first cut-off
list of the students and the name of the petitioner appeared
at serial no. 4 of the list. However, against the name of the
petitioner, the age was mentioned as 8 years, the petitioner
said.
