Govt to give notice to Nitish Katara's mom on convicts' parole plea

 Making it difficult to even come out on parole, Delhi High Court on Friday said the government has to give prior notice to Nitish Katara's family before deciding any such plea or even remission of sentence of the convicts.

New Delhi: Making it difficult to even come out on parole, Delhi High Court on Friday said the government has to give prior notice to Nitish Katara's family before deciding any such plea or even remission of sentence of the convicts.

"In case an application for parole or remission is moved by the defendants before the appropriate government, notice thereof shall be given to Neelam Katara as well as Ajay Katara by the appropriate government and they shall also be heard with regard thereto before passing of orders thereon," a bench of justices Gita Mittal and J R Midha said.

While Neelam Katara is the victim's mother who fought the case which was shifted from Uttar Pradesh to Delhi on her plea by the Supreme Court, Ajay Katara is a cousin of Nitish and based in Ghaziabad.

The particular direction assumes importance as the bench today awarded enhanced punishment of life imprisonment, making it clear the convicts Vikas and Vishal Yadav would not be considered for any remission before they serve 30 years in jail.

The direction will also be applicable on third convict Sukhdev Pehelwan who would not be entitled for any remission till he serves 25 years in jail.
