New Delhi: The Delhi High Court on Friday set aside the police order refusing arms license to a doctor for his personal safety and directed the licensing authority to issue the same to him within eight weeks.
Allowing the plea of Sahil Kohli, a doctor by profession, Justice V K Jain said "the orders of December 26, 2012 of the Licensing Authority and July 24, 2013 of the Lieutenant Governor(LG) of Delhi are hereby quashed.
"And the respondent (Additional Commissioner of Police, Licensing) is directed to grant an appropriate licence to the petitioner (Kohli) unless there exists a situation contemplated by Section 14(1) of the Arms Act which would mandate refusal of a licence to him. The order in terms of this direction be passed by the Licensing Authority, within eight weeks," the court said.
Kohli had applied for grant of a fire arm licence for his personal safety and his plea was rejected by the licensing authority on December 26 last year without giving any reason or without hearing him.
Aggrieved by the order, he had approached the LG against the order of Licensing Authority. After hearing Kohli through his counsel, the appeal was dismissed on the ground that there was no specific threat to the his life or property, which would justify the grant of an arms license to him in July this year.
