chit to the Head of the Department of Ophthalmology, Justice S
Muralidhar directed the Ministry of Health and Family Welfare
to conduct a fresh inquiry against the doctor.
The court passed the order on a petition by the
complainant doctor who alleged that proper inquiry was not
conducted against her senior for harassing her which includes
In her plea, the doctor pleaded that the HOD used to
touch her unnecessarily during operation on patients. She
said she was unduly harassed after she raised her voice
against his behaviour.
On her complaint, a committee was set up to go into the
allegation but she alleged that it was not properly
constituted as per the Supreme Court guidelines and its
functioning was biased against her.
Accepting the plea of the victim doctor, the court set
aside the findings of the committee and directed the
government to conduct a fresh probe against him.
The court also asked the Ministry to decide whether the
HOD should be transferred to another hospital, which is
required for fair proceedings of inquiry against him.
