Man gets Rs 6.07 lakh for injuries in pvt parts in accident

New Delhi: A Motor Accident Claim Tribunal (MACT) has awarded a compensation of Rs 6.07 lakh to man who became unable to produce a child due to injuries in his private parts after being hit by a speeding vehicle in a road accident.

"The trauma of having the feeling even before being married that he will be unable to produce a child is of that magnitude that it will be unimaginable as to what he would be undergoing even at the mere thought of it. It is loss of dream of having one's own child which no amount of money how so ever high can compensate," Presiding Officer Swarana K Sharma said.

Victim Aftab, along with his friend Usman, was going to Jama Masjid on a two-wheeler for offering prayers when their vehicle was hit by a dumper from the rear near Rajghat, leading to injuries to him on September nine, 2006.

He suffered injuries in his private parts leading to removal of his both testicles.

The court took a sympathetic view of the loss to the victim who would be facing problem in getting married as he would never be able to produce a child.

"The petitioner was unmarried at the time of the accident. The very fact that he will not be able to produce a child has surely affected his prospects of marriage. It cannot be denied that upon this fact being disclosed, he will have difficulty in getting married," the court said.

It directed that the Oriental Insurance Co Ltd, which had insured the Dumper, pay the amount to Aftab within 30 days after holding the driver guilty of rash and negligent driving.

The court had computed the compensation while also taking into account the loss of earning capacity of the victim, medical expenses, besides the pain and sufferings.
