New Delhi: Holding that a minor`s consent for marriage or sexual intercourse has no legal sanctity, a
Delhi court has sentenced a man to seven years in jail for marrying a 14-year-old girl and raping her for over 10 months.
Additional Sessions Judge S K Sarvaria sentenced Sushpal, working as a servant in Greater Kailash area in South Delhi, to seven years rigorous imprisonment despite noting that the marriage between the two appeared to be having the girl`s consent.
"It appears that the marriage between the girl and the accused was a consent affair. However, it is another matter that her consent, she being below 18 years of age was immaterial for marriage and sexual intercourse," the judge said.
"Her marriage, being not performed by her parents with the accused, the consent of the girl, who was below 14 years of age, for marriage or sexual intercourse with the accused, is no consent in the eyes of law," he added.
The case dated back to October 2005, when the minor daughter of an Uttam Nagar resident went missing along with her friend, living in her neighbourhood. As the missing girls did not return, the girl`s father lodged a criminal case with Uttam Nagar police station, suspecting that his daughter had
