Pay Rs 4 lakh compensation to accident victim: HC to Railways

The Delhi High Court has directed the Indian Railway to pay compensation of Rs 4 lakh to a man who lost his hands and feet after he fell off a moving train soon after it left Nizamuddin Railway station in 2004.

the Indian Railway to pay compensation of Rs 4 lakh to a man
who lost his hands and feet after he fell off a moving train
soon after it left Nizamuddin Railway station in 2004.

Justice Mool Chand Garg allowed a petition for
compensation filed by Sanjay Kumar and directed the railways
to pay the amount to him with 9 per cent rate of interest
within a month`s time.

In his petition, Kumar challenged an order of the Railway
Accident Claim Tribunal which dismissed his compensation plea
of Rs 4 lakh as the treatment was very expensive.

"The finding of tribunal on the issue of compensation
cannot be sustained. The compensation payble to Kumar as per
the schedule in the case of injuries suffered by him clarify
that he is entitled to receive compensation to the tune of Rs
4 lakh...," the court said.

Kumar said on October 25, 2004, he had boarded the local
train from Nizamuddin station to Faridabad but due to sudden
jerk he fell off the moving train and had received grievous
injuries.
