New Delhi: A Delhi court today fixed the
pronouncement of sentence on September 8 against a teacher of
a reputed music school here who was convicted for outraging
the modesty of a 10-year-old student almost six years ago.
"Now, fix the matter for order on sentence on September
8," Additional Sessions Judge (ASJ) Sanjiv Jain said while
adjourning the case.
The ASJ had on August 25 dismissed the appeal of the
teacher of Delhi School of Music, Dileep Soloman, filed
against his conviction and one year jail term awarded to him
by a magisterial court last year.
Soloman, a piano teacher, was awarded one-year jail term
by Metropolitan Magistrate Geetanjali Goel who had held
him guilty under section 354 (outraging the modesty of woman)
and 509 (making indecent gesture to insult a woman) of IPC.
Dissatisfied with the judgement, the convict teacher had
filed the appeal before the Sessions Court saying he was
wrongly convicted by the magistrate.
On the other hand, the prosecution, represented by S K
Dass, had also filed an appeal for enhancement of the prison
term saying the victim was an "innocent, minor and hapless"
student.
"The convict was a teacher and committed the offence
with a 10-year-old student. He does not deserve to be let off
with such a lighter punishment," the prosecutor said.
Soloman, who was working at Delhi School of Music, had
outraged the girl's modesty on February 27 and March 19 in
2004 in the school premises.
The Sessions Court, in its judgement, relied on the
testimony of the minor victim. It also said the allegation
that the girl had a motive to implicate was not proved.
