Bail plea of IPS officer accused in Tulsi case rejected

Sessions court in Palanpur today rejected bail application of IPS officer Vipul Agarwal arrested in connection with encounter of Tulsi Prajapati, a key witness in Sohrabuddin case.

District and session Judge M A Kadiwala rejected the
bail application of Agarwal who was SP of Banaskantha when
Prajapati was killed in a fake encounter in 2006.

The court rejected the argument of Agarwal`s lawyer
who pleaded that conspiracy theory against his client cannot
be established as the motive behind the murder of Prajapati
was not mentioned in the chargesheet filed by the
investigating agency.

Agarwal was charged for conspiring to kill Prajapati
along with other state IPS officers D G Vanzara, Rajkumar
Pandian and Dinesh M N of Rajasthan cadre.

Agarwal was arrested on May 3 by the state CID
investigating the Tulsi encounter case.

Prajapati, who was considered to be a key witness in
Sohrabuddin fake encounter case, was killed in an encounter
near Chapri village near Ambaji in Banaskantha district when
he tried to escape from custody while being shifted from
Rajasthan to Gujarat in December 2006.

Lawyer of Agarwal, S M Modi said that they will now
take the matter to the high court.
