Ahmedabad: The Gujarat High Court on Thursday issued notice to the Central Warehousing Corporation(CWC), on the issue of damage to over 3,000 quintals of wheat worth Rs 3.5 crore, due to rains at Vadodara railway station last week.

A Division bench of Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala after hearing a public interest litigation (PIL) on this issue today also issued a notice to Western Railway's (WR) divisional manager, Food Corporation of India's (FCI) director and the secretary, ministry of agriculture.

Ritesh Subhashbhai Koshti, a resident of Ahmedabad on the basis of media reports, filed the PIL through advocate Ashish B Desai, demanding prosecution of the concerned officers by Central Bureau of Investigation (CBI).

"On behalf of the FCI, the CWC had unloaded 24000 bags containing 3000 metric tones of wheat from Madhya Pradesh on August 10 at Vadodara railway yard under open sky," the petitioner alleged in the PIL.

"There was a heavy rain at Vadodara on August 12 because of which most of the wheat got wet at Vadodara Railway Yard, as the concerned authorities failed to shift the consignment to a godown on time," the PIL further alleged.

Apart from a criminal prosecution by CBI against responsible officials, the petitioner has sought a departmental inquiry and also requested the court to direct the responsible officers to personally compensate the total amount of loss suffered.

Further hearing on this PIL will be held on August 30.

Delivering the judgment yesterday, the court slammed the Modi government, terming the 2002 communal conflagration as “negligence of the state” and censured it for “inaction”, holding that it had resulted in an “anarchic” situation. “Even if we, for the sake of argument, accept the defense of the state that the cause of riot was a general reaction to the Sabarmati Express incident, the failure on part of police to gather intelligence about such general reaction (after the Godhra train burning incident) in time and to take appropriate timely action definitely come within expression `negligence of the state`,” the court said

The court held that the policy adopted by the state government restricting compensation only to damaged residential and business premises and not extending it to places of worship was violative of the fundamental rights guaranteed under Articles 14, 25 and 26 of the Constitution. “The policy of the state government taken in defence is one of evading the constitutional responsibility and will bring anarchy in the society, and thus, is detrimental to the establishment of the principles and the tenets of our Constitution,” reads the order

The HC, in its verdict delivered yesterday, deplored the fact that no explanation had been given by the state government for not placing annual and other reports of the HHRC on restoration of religious structures before the Assembly till today despite receiving them in early 2005. “Such grave lapse on the part of the state government amounts to clear violation of Section 20 of the Protection of Human Rights Act, 1993,” an order by the Division Bench of acting Chief Justice Mr Bhaskar Bhattacharya and Mr Justice JB Pardiwit reads.

How can Modi and his followers could forget that there is no no development in rural and tribal areas of Gujarat? Modi has hired PR agencies to project himself as man of development and one who can become the PM but the reality on grass root is totally different. Modi has allowed industrialist to loot Gujarat and if he becomes PM, he will let entire world to loot India...
