PIL challenging senate membership of Desai filed in Guj HC

A PIL was on Monday filed in the Gujarat High Court challenging the unanimous election of former Medical Council of India (MCI) chief Dr Ketan Desai as senate member of Gujarat University (GU).

Ahmedabad: A PIL was on Monday filed in the
Gujarat High Court challenging the unanimous election of
former Medical Council of India (MCI) chief Dr Ketan Desai as
senate member of Gujarat University (GU).

The PIL has been filed by former GU senate member
Raghuvir Gadhiya, through his lawyer Hitesh Dave, seeking
cancellation of Desai`s senate membership contending that the
ex-MCI chief was arrested by CBI in a corruption case and for
having disproportionate assets.

The CBI had on April 23 arrested Desai who was then the
MCI chief and two others for allegedly accepting a bribe of Rs
two crore to grant recognition to a Punjab-based private
medical college.

They were booked by CBI under various provisions of
Prevention of Corruption of Act, dealing with inducing a
public servant to accept bribe, criminal misconduct and
payment of money.

In his PIL, Gadhiya has sought cancellation of Desai`s
candidature under section 46 of the Gujarat University`s Act.
The section provides that a senate member can be suspended for
having scandalous behaviour.

Gadhiya has also blamed the GU Vice Chancellor for not
initiating any action despite being in knowledge about Desai`s
tainted past.

Desai recently won the senate membership after another
candidate withdrew his candidature.
