New Delhi: The Supreme Court on Monday rejected the plea of controversial Gujarat Cadre IPS Officer Kuldip Sharma seeking that all matters relating to his conduct as a civil servant, which is coming in the way of his promotion, be placed before the Governor, saying such a prayer can`t be granted.
Sharma had sought placing of service matters relating to him, including his Annual Confidential Ratings (ACRs), before the Governor or any other constitutional authority, alleging that Chief Minister Narendra Modi was acting against him with biased and malafide intentions.
"All matters which come within the competency of the state government will go to the state government," a bench comprising justices T S Thakur and F M Ibrahim Kalifulla said.
The bench, which questioned the relief sought by the senior IPS officer, said he has a remedy to approach the Gujarat High Court or preferrably the Central Administrative Tribunal.
"You go to the Tribunal and get a finding recorded that the action of the state government is malafide," the bench said.
"It cannot be that a civil servant under the Centre can say that all his matters should be placed before the President who is the highest authority. What kind of prayer is this for placing your matters before the Governor"? said the bench which later allowed Sharma`s counsel to withdraw the petition.
