Sohrabuddin case: ‘Innocent’ Shah resigns, Congress says too little New Delhi: In a dramatic turn of events, Gujarat Chief Minister Narendra Modi Saturday announced resignation of his Minister of State for Home Amit Shah, allegedly involved in the 2005 staged killing of Sohrabuddin Sheikh, but the Congress termed it "too little, too late."

"Amit Shah has sent his resignation to my bungalow. I will complete the formalities after returning from here. I accept his resignation," said Modi, who arrived here to attend the 55th meeting of the National Development Council, the country's top policy forum, which was chaired by Prime Minister Manmohan Singh.

Modi, who had kept mum on the entire controversy, told reporters that Shah was innocent and alleged that the United Progressive Alliance (UPA) government was misusing the Central Bureau of Investigation (CBI) to fabricating the case against Shah, his close aide.

Meanwhile, reports from Ahmedabad said the CBI continued to hunt for Shah, who went absconding Thursday. The chief metropolitan magistrate of Ahmedabad Friday rejected Shah's plea for anticipatory bail.

The chief minister added that the due legal course will be followed by Shah. "Amit Shah will respect the legal system of the country. And I believe the Indian law will give him justice," said Modi.

The Congress quickly rubbished the resignation announcement.

Congress spokesperson Abhishek Manu Singhvi told reporters that with Shah and several police officers charged with murder, extortion and abduction in the case, "the true face of the Bharatiya Janata Party (BJP) has been exposed".

"The resignation has come too little, too late. To resign after resisting and delaying the issue for days and weeks is not graceful nor voluntary. There is no remorse, no contrition, no acceptance and no apology. The BJP leadership and Narendra Modi are fully supporting and justifying the actions till now."

Singhvi added that BJP was resorting to all these tactics as Shah was important to Modi and Modi was important to BJP.

Home Minister P. Chidambaram also questioned BJP's intention, saying the party should have spoken out when the case was taken up in the Supreme Court in January this year. "Why this belated and stimulated reaction," he asked.

But an angry Modi alleged that the charges against Shah were part of the Congress-led central government's "conspiracy" against Gujarat. "It is an example of a conspiracy to trouble the development of Gujarat. Amit Shah is totally innocent. The allegations are fabricated and politicised," the chief minister said.

Modi said getting the CBI involved in the case was a reaction from a "failed" central government.

"When the people of India expressed their anger and warned the government in Delhi against price rise in the form of a massive bandh, the Congress-led central government which has failed on all fronts completely politicised the CBI and are misusing it. They are trying to create obstacles in the way of Gujarat's journey to development," Modi added.

The BJP also quickly came to Modi's aid. "The Congress needs to learn that the more they try to scratch Modi, it will boomerang on them," party spokesperson Ravi Shankar Prasad told reporters here. He also ruled out any possibility of Modi stepping down.

Congress party general secretary B.K. Hariprasad also slammed Modi, saying he has no right to criticise the CBI as the probe was held under the supervision of the apex court.

"By attacking CBI, the BJP is attacking the apex court. The CBI investigation is being monitored by the Supreme Court. And Modi is speaking against the Supreme Court," Hariprasad said.

Sheikh was killed in an alleged gunfight with the police Nov 26, 2005 and police accused him of being a Lashkar-e-Taiba activist. They claimed he had come to Ahmedabad to target senior political leaders. His wife Kausar Bi went missing later.

The CBI, which took over the case under Supreme Court direction, had charged 14 police officers of Gujarat and Rajasthan with abducting and killing Sheikh. Based on the telephonic conversation records between the police officers and Shah during the course of the "encounter", the CBI has charged Shah too with murder.

it may be recalled that amit shah, minister of state for home in h gujarat govt., who hasskipped two summons of cbi and consequently charge-sheeted by it his application for anticipatory bail has also been refused by the court! and the law is hunting him and he has thus become ``fugitive from law!
cm of gujarat has declared to the press in delhi that he has sent his letter of resignation to cm`s bungalow and he has accepted it(from delhi)!``
the moot question is how could the cm be os sure that it was the letter of that fugitive, when he has mnot said as to from where he has sent it and how he has sent it?
under the circumstances the over-riding constitutional obligation of the cm is not its acceptance but locating him nad make him appear before the law.
instead of that hehas chosen tohold brief for him!

many of us must agree with rohit prajapati - vadodra- gujarat remarks, veteran lawyers are in bjp then why mr shah hide? other things how come same cbi is bad for bjp this time and very good when cbi give clean chit after former gujrat home minister mr. haren pandia murder? also for one single case of fodder scam there where about 50 deferent police and cbi cases made for lalu prasad yadav by cbi under guidance of top bjp leader mr adwani for his personal revenge, then cbi was very good? so let law to handle though we all know big leaders never come under law net as they have much illegal way to come out. there is pressure tactics started for this by mr modi, bjp and media to make headline so called” innocent” for a murder,extortion and many more charge-sheeted minister

gujarat home minister is underground. what a disturbing reality? the way the bjp leadership is defending mr. amit shah is not surprising but expected one.

mr. amit shah and his party should not waste any more time and they should approach supreme court and articulate their viewpoint that “cbi is manipulated and misused by congress in this case. … the encountered persons are terrorist so the state has right to kill them.”. if amit shah and his party do not take this view point to supreme court then it is very clear that their these defenses are formal, casual, made in frustration and irrelevant one and they are trying to sidetrack the main issues.

the bjp has “competent lawyer” like mr. arun jaitely and mr. ram jethmalani then why they had not approached and are not approaching the supreme court if they believes that the cbi is manipulated by congress.

true statment given by modi. according to a y dave sorabudin was killed because he had terrorised marbal traders it self proven that he was a terrorist. so nothing wrong to kill him by hook or cook. once again congress failed to win heart of gujrat. gujrati believe in equal justice for all religious but congress always favour hardcore muslim criminal/teerorists

one thing these arguments between bjp and congress leadership prooves that both political paries have misused their powers and killed innocent people for their political gains. first the congress party was involved in 1984 sikh massacre and then bjp followed them killing innocent muslims in gujrat. now the cbi and justice system are charging gujrat`s bjp minister and police officers for fake encounters and innocent killings in gujrat. while bjp is crying and calling it foul play, the congress leadership is commending the cbi and justice system. but the whole thing prooves that cbi & justice system is controlled by the ruling congress party. that is why cbi knows about the guilty bjp leaders and police officers for their role in gujrat. but the same cbi don`t know anything the guilty congress leaders and police officers involved in 1984 sikh massacre of innocent people in delhi and fake encounter killings in punjab. cbi and justice system close their eyes because the ruling congress leadership doesn`t want them to punish the guilty congress leaders and police officers. i don`t know how the congress spokesperson calls his party caring for humanity and law and order. if they really care for law and order then why have they failed to punish the guilty involved in 1984 massacre in more than 25 years ? the bjp and media should question the congress leadership when will we see the guilty involved in killing thousands of innocent sikhs in 1984 massacre punished for their crimes ?
