Sohrabuddin case: Two accused seek stay on voice sample

A special court, hearing the Sohrabuddin Sheikh fake encounter case, issued notice to CBI on an application by two accused seeking extension of stay on the order allowing the central agency to collect their voice samples.

Ahmedabad: A special court, hearing the
Sohrabuddin Sheikh fake encounter case, today issued notice to
CBI on an application by two accused seeking extension of stay
on the order allowing the central agency to collect their
voice samples to compare it with audio-video evidence.

Suspended IPS officer Abhay Chudasama and sub-inspector N
V Chauhan today filed an application in the special CBI court
asking for extension of stay on the order allowing CBI to take
their voice samples, by ten days so that they can appeal in
higher courts.

Additional chief judicial magistrate A Y Dave issued
notice to the CBI asking them to file a reply on the
application by November 16.

The court on October 26 had allowed CBI to collect voice
sample of Chudasama, Chauhan and another accused N K Amin, who
had offered to become an approver in the case. The court had
also stayed the execution of the order for two weeks for the
accused to approach the higher forum.

CBI during the argument had contended that voice samples
of the accused was needed to verify their voices on some
audio-video evidence that the agency had.

The court had also disallowed permission to collect voice
samples of accused Ajay Patel and Yashpal Chudasama, saying
that they were not arrested in the case and charges against
them are premature.
