HC direction on delay tainted officials’ cases

Himachal Pradesh High Court on Thursday directed the Chief Secretary to depute an officer not below the rank of Under Secretary to deal with such files pending before the state government.



Shimla: Taking note of inordinate delay in
grant of sanction for prosecution of tainted officials,
Himachal Pradesh High Court on Thursday directed the Chief Secretary
to depute an officer not below the rank of Under Secretary to
deal with such files pending before the state government.

A division bench headed by Chief Justice Kurian Joseph
passed the order after the Centre informed the court that it
was not responsible for the delay in grant of sanction for
prosecution and the state government was to be blamed.

The court had directed the Union Ministry of Personnel
Affairs to explain as to why there was inordinate delay of
more than a year in taking final decision with regard to the
prosecution sanction in various cases even as the apex court
had directed that prosecution shall not be delayed beyond
three months.

In its reply, the central government pointed out that the
response of the state government was received after around
seven months in one case and after nearly three months in
another case.
