Distance degrees invalid, says J&K HC

Srinagar: Hundreds of government employees in Jammu and Kashmir are facing the prospect of dismissal or demotion as the state High Court has declared as "invalid" the degrees awarded through distance education mode.

Disposing off 15 clubbed petitions, Justice Mansoor Ahmad Mir rejected the plea of the petitioners to treat degrees obtained through distance mode equivalent to those obtained after attending regular classes.

"It is shocking to observe the manner in which the post graduate degrees have been conferred on the students...All the writ petitions are held to be without any merit, and are, therefore, dismissed," Justice Mir said in the eight-page order.

"The petitioners, who are before this Court, seeking direction in the name of respondents to give due weightage to their higher qualifications...Indeed want this Court to put its seal on the said illegal act," he said in the order passed recently.

Degrees awarded by IGNOU, DOEACC and Maulana Azad National Urdu University's (MANUU) have been held valid.

Official sources said that the order of the High Court is going to affect hundreds of government employees in Jammu and Kashmir as they have gained employment or promotions based on the qualifications obtained through distance mode.

In some cases, degrees have been obtained from institutions which are not even recognised by the University Grants Commission (UGC), the sources said.

They said the Education Department and Youth Services and Sports Department have the maximum number of beneficiaries of these degrees.

Over 100 Physical Education Teachers have been promoted to next higher grade while few Physical Education Masters have been promoted as Lecturers, the sources said.

Director of Youth Services and Sports J P Singh said that he has not yet received the High Court order on the matter. "We will examine the order and see what action is warranted," he added.

Advocated General Mohammad Ishaq Qadri said the High Court order has made illegal every benefit accrued by a person in government service due to these degrees.

"Since it is a policy matter, the Government will have to decide on whether these benefits will be withdrawn or a one-time exception will be announced," Qadri said.

In view of the gravity of the situation, Justice Mir in the order had observed "the affairs of the PRIST (Ponnaiyah Ramajayam Institute of Science and Technology) and other universities cannot be allowed to go unchecked. Therefore, it becomes imperative for this Court, being the custodian of public interest, to play its role."

The court directed the state Chief Secretary to conduct a thorough probe into the matter.

"While dealing with the matter, the Chief Secretary shall bear in mind the seriousness of the issue and may even go for registration of a criminal case if, in the fitness of things, it is so desired. And on doing so, he shall personally monitor the investigation," the court said.

I strongly favour HC order. This is the right step against eradicating roots of those who obtained fake degrees and are sitting on responsible positions as they are not aware of the work to be done. A regular student strive whole the year to get that much good marks that a student just earn by sitting at home without knowing even what is an exam and are in teaching profession.This will be a good step for the better future of the state to raise quality education. Fake degrees obtained through Distance Education should be totally banned and strong actions against institutes conducting distance Education programs must be closed was to avoid selling degrees.

If J&K HC ordered illegal those degrees who has been obtained by distance mode except DOEACC and IGNOU. Then, what is the future of those studnets, who got degree from those universities made by ``SECTION 3 OF UGC ACT 1956``. What does it mean harassing or grazing to innocent students. I think, in future all study centre centres should be closed by order of J&K HC/Supreme Court of India. Then all the issues will be solved.

i think Justice Mansoor Ahmad Mir is a correcpt person.why he order MANNU DOACC and IGNOU degrees are accepted .why kssb accept bharkat ullha university degrees students can not study thereregular that regular registration but students will apear only in exams same as all other universities out of kashmir.one thing more kashmir university was accepted prest BED degree in 2012.it is not justic its only TRP.ok why our state Govt. allows such institute to run in state. its joke by HC. and JandK govt. is playing with students with HC Degrees awarded by IGNOU, DOEACC and Maulana Azad National Urdu University`s (MANUU) have been held valid why

Justice mir told Degrees awarded by Maulana Azad National Urdu University`s (MANUU) have been held valid. but i want to tell that MANUU is also involved in that fake work as in punjab Malerkotla there is center of MANUU. They give permisson to student to complete there paperes from books and even those students got degree of M.A from there who did not know urdu laguage as we know the medium of instruction in MANUU is urdu then How they got degree

Than why our state Govt. allows such institute to run in jandk .. in jandk students pays tax for study .. you can take example of niit students they pays tax @8.4% per month. its joke by HC. and JandK govt. is playing with students with HC..

This kind of discrimination should be challenged in court.Yes it is high time for the authorities to bring distance degress of all universities including kashmir university under the purview of this very notification. Distance degrees obtained from indian universities are recognised by the same DEC like kashmir university. Indian govt should take counetr step by way of considering kashmir university degrees fake for higher education. How can kashmir university rum bed and m.ed without NCET approval.
