J&K High Court stays execution of PSA against minor

The Jammu and Kashmir High Court has stayed execution of the stringent Public Safety Act against a minor booked for stone pelting.

Srinagar: The Jammu and Kashmir High Court
has stayed execution of the stringent Public Safety Act
against a minor booked for stone pelting.

15-year-old Arshad Majeed Sofi was arrested in January
and booked under PSA, which enables the police to arrest a
person and keep him in jail without any trial for two years.
Staying his detention, Justice Mohammad Yaqoob Mir
yesterday observed that the order be kept in abeyance because
of the "non-applicability" of mind by the detaining authority.

"There appears to be non-applicability of mind on part of
the detaining authority while passing the detention order
under PSA. The petitioner has been shown bailed out in two
FIRs registered against him, but beyond those two FIRs no new
grounds have been shown against him," the court said, adding
there is nothing compelling in the PSA dossier which would
warrant invoking the stringent law against the boy.
The court posted the case for hearing next week.

The petition seeking a stay on execution of PSA order
was filed by the boy`s parents in first week of March.
