Transfer of BMTF Chief quashed

The Central Administrative Tribunal on Friday quashed the transfer of Bangalore Metropolitan Task Force Chief ADGP R P Sharma.

Bangalore: The Central Administrative Tribunal on Friday quashed the transfer of Bangalore Metropolitan Task Force Chief ADGP R P Sharma, observing that the amendment to the Police Act cannot in any way concern the applicant`s (Sharma) transfer as it does not cover an ADGP rank officer.

CAT`s judicial member (Bangalore bench) K B Suresh also ordered that Sharma should be allowed to work out his full tenure as Chief of BMTF.

The BMTF chief was facing a lot of criticism from Bruhat Bengaluru Mahanagara Palike (city corporation-BBMP) officials who were being investigated for penal offences and in many cases chargesheet had also been filed.

The BBMP employees then went on a `total` strike which was called off in the wake of an appeal by the state government as the agitation was impacting the common man and Independence Day was round the corner.

The state government had assured the striking employees that it would meet their demands which were; transfer of R P Sharma, dilution of BMTF powers and withdrawal of all cases against them. Subsequently Sharma was transferred.

The CAT`s judicial member directed Sharma to begin immediate investigation of violations in respect of all employees of jurisdictional matrix so that the guilty are brought to book.

The member directed the state government to extend all possible manpower and other assistance to BMTF, to speedily bring to book all erring officials.

Government has also been directed to make speedy and effective arrangement for replacements of officers who might be in pre-trial custody, so that at any stage public interest will not suffer.

Sharma was appointed ADGP BMTF in January this year and should have been continued till Dec 31, 2013.

He challenged the transfer and filed a petition before CAT, Bangalore with a prayer for interim relief. This was, however, opposed by the state government.
