Assault on undertrial in jail: HC asks CS to file response

The Bombay HC today asked the Chief Secretary to Maharashtra govt to file a response within two weeks explaining what action the state had taken against jail officials who had allegedly assaulted an undertrial.

response within two weeks explaining what action the state had taken against jail officials who had allegedly assaulted an
undertrial in prison last year.

Hearing an application filed by undertrial Abdul Shaikh,
Justices B H Marlapalle and Anoop Mohta asked the Chief
Secretary to inform what steps had been taken in this regard
against the officers of Arthur Road jail.

Shaikh had filed a petition alleging that he was
assaulted by Arthur Road jail staff. A division bench, hearing
his petition, had given a finding that Shaikh had been
assaulted and asked the state to take action against the
officers concerned.

The petitioner`s lawyer through an RTI application learnt
that no action had been taken against the jail staff. Being
aggrieved, the petitioner filed an application in the High
Court informing about the RTI reply of the government.

Hearing this application, the court asked the Chief
Secretary to file a response within two weeks.
