Children worst victims of broken marriages: HC

In divorce matters, children suffer the most and face a lot of trauma, the Bombay High Court observed.

Mumbai: In divorce matters, children suffer the most and face a lot of trauma, the Bombay High Court on Tuesday observed.

"Children suffer the most between a divorced husband and wife. They get scared and traumatised in the fight between the parents. Every father and mother wants to spend some quality time with their children but they have to see the needs of the child too," the court observed while hearing a divorced man`s plea, seeking permission to take his 13-year-old son, who is in his mother`s custody, to hill stations during summer vacation.

The division bench comprising Justices PB Majmudar and Anoop Mohta also expressed displeasure when it was pointed out by the lawyer of the petitioner`s wife that he had a daughter from his now annulled marriage but has not expressed any wish to take her out for vacation.

"Why do you want to take only the son out? We saw a serial about how families want only male child and how female foeticide is on a rise," Justice Majmudar said referring to the television show `Satyameva Jayate` anchored by actor Aamir Khan.

After the wife`s advocate told the court that the son himself did not wish to go with his father, the bench interviewed all the parties - the son, wife and father - individually in the chamber.
After interviewing them, the court permitted the father to take the son for vacation from May 14 to May 21. He has directed the man to hand over the son to his wife on May 21.
The couple`s marriage was dissolved by the family court on January 10, 2011. The family court granted permanent custody of the children to the mother and granted access to the father who has challenged the order in the high court.
