HC asks church to approach BMC over land-demand notice afresh

Mumbai: In a partial relief for St Stephen`s
Church in south Mumbai, the Bombay High Court on Monday directed
it to make a fresh representation to the Brihanmumbai
Municipal Corporation against a land acquisition notice.

BMC wants a part of the Church premises for road
expansion.

The division bench of Justices DK Deshmukh and KK Tated
asked the petitioner, Reverend Jude Pereira, who is one of the
trustees of the Church, to approach the BMC afresh.

According to the petition, the BMC had made a similar
demand in 1973, and a part of the Church land had been given
for road-widening. BMC had then said no more land would
be sought in the future, petition said.

"If more land is given then the steps of the Church
would directly lead out to the main road, which could lead to
accidents on important days when several people come to the
Church," advocate Joaquim Reis argued.

The petition had sought quashing of the notice.
