Thane: A 43-year-old man was sentenced to
six-month imprisonment for mandhandling and abusing in name of
caste, a building contractor here in 2008.
Sessions Judge A A Sayeed convicted accused Achutanand
Pande and fined him with Rs 1,000 for hurling caste abuse on
Narsaiya Jalla, a native of Andhra Pradesh who belonged to
"Mala", recognised as a scheduled caste.
Pande`s wife, two sons, and a couple---Sushila A Pande,
Ajay A Pande, Vijay A Pande, Tripurari K Pande, and Sunita
Tripurari Pande--- who were also tried in the same case but
were set free by the court for want of sufficient evidence.
The accused and the complainant were locked in a dispute
over a land piece which belonged to Pande, who had entered
into an agreement in 2004 for its development with Narsaiya to
build a chawl with 16 rooms .
As the locals filed complaint with the Thane Municipal
Corporation, it demolished the rooms. When it was built for
the third time, the accused was promised some rooms and rest
were to be sold, the court was told.
In due course, Narsaiya was allegedly harassed for
allotment of rooms and on July 23, 2008 he was called to a
school here in Wagle Estate and manhandled.
The case was tried in the Thane court for the offences
punishable under sections 143,148, 323, 504 & 506 (2) of the
IPC and Section 3(1)(x) of Scheduled Caste and Scheduled Tribe
(Prevention of Atrocities) Act, 1989.
The court held that the accused Pande had commited an
offence and jailed him.
