Abu Salem`s trial can go on: CBI

The CBI on Wednesday told a special TADA court here that the trial of extradited gangster Abu Salem can go on unless Supreme Court passes an order.

Mumbai: The CBI on Wednesday told a special TADA
court here that the trial of extradited gangster Abu Salem can
go on unless Supreme Court passes an order.
"Unless an appropriate court passes any order or
notification, asking to abide by the order of the court in
Portugal (which revoked the extradition) this court has the
jurisdiction to conduct the proceedings against Abu Salem,"
the CBI reply says.

Special public prosecutor D N Salvi told the court here
that the prosecution can be stopped only if so notified by
the Supreme Court of India or the Government of India.
The reply follows application by Salem`s lawyer, claiming
that that in view of the termination of extradition by the
Portugal court, the gangster cannot be tried here.

New Delhi has already challenged the termination order in
Portugal`s apex court.

The court is likely to pass order on Salem`s plea on
October 20.
