"Who decides the waiting list? Where in the Constitution
is it written that there should be a waiting list of those who
are to be hanged?" BJP Chief spokesperson Ravi Shankar Prasad
The senior BJP leader insisted that convicts on death
row who have waged a war against the country should be
hanged before others facing a death sentence even if their
sentence was given later.
"There is no statutory backing to this logic (of going by
the waiting list of those on death row)," Prasad said, adding
that the legal process had evolved over the years.
"Mumbai attack accused Ajmal Kasab`s trial was expedited
through a fast track court," he said, citing an example.
He also dismissed suggestions by some Congress members
that hanging Afzal may lead to a riot in some parts of the

However, Congress denied there was any attempt to delay
the process in Afzal`s case.
"Obviously the process of sending the recommendation (on
Afzal`s hanging) is to expedite and lead to conclusion of the
entire process of making a final decision. Naturally that
process is intended to culminate in a conclusion," Congress
spokesperson Abhishek Manu Singhvi said.
