Allahabad HC stays CAT order on suspension of 2 IAS officers

The Allahabad High Court on Monday stayed an order of the Central Administrative Tribunal`s bench here putting on hold on the suspension of two IAS officers in connection with a land scam in Noida.

Allahabad: The Allahabad High Court on Monday stayed an order of the Central Administrative Tribunal`s bench
here putting on hold on the suspension of two IAS officers in
connection with a land scam in Noida.

The order was passed by a Division Bench comprising
Justice Sunil Ambawani and Justice K N Pandey on a writ
petition filed by Uttar Pradesh government, through the
state`s chief secretary, challenging the CAT`s order dated 21.
01.2010 whereby the suspension of Rakesh Bahadur and Sanjeev
Saran had been stayed.

The two IAS officers were suspended on August 09, 2009,
and subsequently named in an FIR lodged in connection with
alleged financial irregularities in allotment of plots in the
year 2006-07 for construction of hotels in Noida.

Staying the order of CAT, the court was of the view that
the Tribunal "has exceeded its jurisdiction in staying the
suspension order and has granted final relief at the stage of
admission itself".

"It appears that the CAT has passed the order in
annoyance with the appellate authority`s failure to decide the
appeal against the suspension order within the specified
period of time. The Tribunal seems to have failed to consider
the merits of the case", the court added.

Giving four weeks` time to the respondents to file their
counter affidavits, the court fixed April 29 as the next date
of hearing.
