Amnesty denounces sentencing of Binayak Sen

Amnesty denounces sentencing of Binayak Sen  London: Amnesty International said on Saturday that the life sentence handed down to Indian rights activist Binayak Sen for his alleged Maoist links violates "international fair trial standards".

It is also "likely to enflame tensions in the conflict-affected area" of Chhattisgarh, Amnesty said in a statement.

"Life in prison is an unusually harsh sentence for anyone, much less for an internationally recognised human rights defender who has never been charged with any act of violence," said Sam Zarifi, Amnesty's Asia-Pacific director.

"State and federal authorities in India should immediately drop these politically motivated charges against Sen and release him," it said.

Sen, who is also a medical doctor, was convicted on Friday of sedition and conspiracy under the Chhattisgarh Special Public Safety Act, 2005, and the Unlawful Activities Prevention Act, 2004.

He was immediately taken into custody, having been out on bail since May 2009.

"Sen, considered a prisoner of conscience by Amnesty International, was convicted under laws that are impermissibly vague and fall well short of international standards for criminal prosecution," Zarifi said.

"Instead of persecuting Sen, authorities in Chhattisgarh should be acting to protect the people of the region from the abuses committed by the Maoists as well as state security forces and militias.

"This sentence will seriously intimidate other human rights defenders who would provide a peaceful outlet for the people's grievances, especially for the indigenous Adivasi population," Zarifi said.

Sen is a pioneer of health care to marginalised and indigenous communities in Chhattisgarh, where the police and armed Maoists have been engaged in clashes over the last seven years.

Sen was detained without proper charges for seven months, denied bail and kept in solitary confinement for three weeks.

Amnesty said that many of the charges against him stem from laws that contravene international standards. "Repeated delays in the conduct of his trial have cast doubts about its fairness."

Amnesty has repeatedly called on Indian authorities to immediately drop all the charges against Sen.

To my belief a proper and strict action has been taken at last by our judiciary system going against the hermaphrodite nature of Congress Govt. Maoists have turned into a terrorist, criminal, anti-national organization with links with ISI and China taking military and monetary help from them. In stead of protesting against the state torture they are killing common innocent people, teachers, students, forcing children and females to pick guns. If they can kill common people why the police force can`t kill them? Those spineless creatures, so called intellectuals, supporting these terrorists should also be considered as anti-national terrorist and strong action should be taken against them. To my consideration Vinayak Sen should have been hanged openly to set e lesson to these bloody intellectuals.

Since 1999, 5961 civilians & 2086 security personnel have been murdered by maoist terrorists that Binayak Sen acted as courier for them, so he deserved the punishment, Amnesty has a history of supporting such terrorists, Such a shame on them

Unnecessary worry over a man who is charged with supporting a banned organization. Anyways, it is known that almost all communist NGOs are anti-national and doing all sort of dirty works. Lastly the man is pronounced guilty in court. He has to chance to appeal in high court. So take it like another criminal case.

Mr Binayak Sen and his ilk have been running with the hare and hunting with the hound-they have been misusing the freedom of expression and working against the country. Good that some of them have been caught, others would also be, in due course. They represnt the new fascists who consider anybody who does not agree with them as an enemy, be it the govt or an individual. Look at how the Maoists ute the ``police informers`` ! And Amnesty supports them! What a Joke!!

Is binayak sen sedition worse than gilani sedition in kashmir contuinuing for decades together with open collaboration with enemies across the border . But nothng happend to Gilani during last decade .Was it due to perception that Mr gilani if charged would become a martyr, hence difficult to handle or some hope that some day he will comeround to support indian view point . Why couldnt same yard stick be applied to Mr Binayak sen. If former is bad the latter is worse . And on what grounds carrying letters? Arundati roy and now azam khan from Samajwadi party are seditious enough on public platform and beyond rendering postal service.
