Cabinet clears changes in marriage, adoption laws

New Delhi: The Union Cabinet on Friday approved various proposals seeking amendments in the Hindu Marriage Act of 1955 and Special Marriage Act of 1954 aimed at providing ‘irretrievable breakdown of marriage’ as a new ground for parting ways.

The redrafted Marriage Laws (Amendment) Bill, 2010 gives courts the right to reduce or waive off the mandatory cooling period and grant divorce immediately.

The bill, based on key recommendations of a Parliamentary Standing Committee, also allows a woman a share in her husband's property. The quantum of share will be decided by the court on case-by-case basis.

The Marriage Laws (Amendment) Bill, 2010, was introduced in the Rajya Sabha two years ago and then referred to the Parliamentary Standing Committee on Law and Justice and Personnel.

Supporting the bill which sought to make "irretrievable breakdown of marriage" a new ground for grant of divorce, the Standing Committee had in March last year opposed doing away with the prevailing waiting period of six months to 18 months before moving a joint motion for annulling marriage.

The changes made in the 2010 bill are based on the recommendations made by the Parliamentary Panel then headed by Jayanthi Natarajan.

According to the Cabinet note, while a wife can oppose a husband's plea for a divorce under the new "irretrievable breakdown of marriage" clause, the husband will have no such rights to oppose if the wife moves the court on the same grounds.

The government has also made share in husband's property acquired by marriage a right for women who so far used to get maintenance from courts.

A Minister who attended the meeting said the bill lacks any clear cut rule on the share of property a wife will get.

Apart from giving women the right to their husband's property, bill also aims at giving rights to adopted children on par with biological off-springs in case a couple goes for divorce.

The Cabinet meeting chaired by Prime Minister Manmohan Singh cleared the draft bill.

This amendment make miserable gents life i applied for nullify of marriage after marriage ceremony itself girls side have some problem than the went away from me. i have the proof but she only once appear before the court dragging the case for 4 years. If evidence provided by me satisfy the court i can got justification . if unfortunately unable to proof, without living together should i have to give my property to immoral girl one who ruin my family. why this kind of sympathetic one who going towards foreign culture. after this law i decided not to marry any one throught my life i will live like bachelor. this kind of law make women unnecessary fight with men then they will start to claim property & salary.this law should be provided with time duration living together marriage life & also consider their education also ..

hamesha jens ko hi kyon guilty mana jata hai.agar divorce ho raha hai to jens ko bhi lady ki property se hissa mailna chahiye.people shout not make jens only villen.try to know the fact why marriage is not getting sucess.

agar law lana hai to aisa ruls lavo ki husband unlegaly dusri wife na la sake. abh bhi husband dusri wife late hai aur unhe court koi punisment nahi karti. lawer unka sath dete hai. jo lawyer unka sath de unhe bhi punish kijiye. to kafi samaj me badlav ayega. aur divorce causes bahot kam hoge.

Somebody needed divorce in sum politician`s family vey urgently and thus this amendment..when there should be more counsellors there to solve family problems , they have come up with easy divorces...do away with498a as well as easy divorce laws...easy divorces would be bad for society especially in india in long run..has government gone mad..one more reason to not vote for congress..what is so called indian culture saving BJP doing..why its not opposing this to save hindu culture & family system

if so, non of men will get marry. why wife can oppose divorce given by husband? if this law comes in india, all husbands will suicide or kill their wives. give equal opportunity for both. otherwise men will die with aids or any std if they are far from wife without divorce from wife. now a days women`s are cheating their husbands by taking property from them and having another sexual relationship, who is giving more pleasure to them than husbands.

Hindu marriage is a SANSKAR, I am unable to understand that how it can be reverted. If people have the power to revert the MANTRAS and AAHITIES they can revert cremation the ANTIM SNSKAR also and make alive a dead person. Hindu VIVAH SANSKAR is a system where can be no divorce, because no mantras, poojas and pheras can be reverted.
