Allahabad: A government servant convicted for corruption or moral turpitude should not be allowed to continue in service until the conviction is set aside by an appellate court, the Allahabad High Court said today.
A Division Bench comprising Justice Sunil Ambawani and Justice Jayashree Tiwari said "in our opinion, a government servant convicted for corruption or moral turpitude should not be allowed to continue in service until his conviction is set aside by an appellate court".
The order was passed on a writ petition of Ram Narain Pandey who was an accounts officer posted in the office of Basic Shiksha Adhikari of Fatehpur district.
The petitioner was arrested by a team of vigilance and anti-corruption department of Uttar Pradesh on May 06, 1995, for taking bribe.
The petitioner, who has since been suspended, had moved the court with the plea for an increase in the subsistence allowance being given to him.
However, the court rejected the petition with the aforesaid remarks and adding that no stay has been granted by the court on the order of his suspension either.
