New Delhi: Two senior officials of the
Indian Army, husband and wife, have been summoned by a Delhi
court for their alleged role in a cheating case involving
purchase of plots in Uttar Pradesh.
Metropolitan Magistrate Sumit Dass issued summons to
Amita Chaturvedi and her husband V P Chaturvedi, both posted
as Colonels in the Army Medical Corps at the time of filing of
the complaint last year by their friend Lt Col (retd) M P
Sharma.
"Both accused persons are summoned for offence under
section 420 (cheating) / 506 (criminal intimidation) read with
section 34 (common intention) of the IPC upon filing of
process form and copy of the complaint for September 1," the
court said.
MP Sharma, in his complaint through advocate Ranbir
Sharma, submitted both the accused, being his friends for the
last 10 years, induced him to pay Rs 4.63 lakhs to them for
purchasing plot jointly with them saying they have friendly
relations with bureaucrats and politicians in Uttar Pradesh.
The accused said that with the help of those
politicians and bureaucrats, they can get him a huge
industrial plot in Uttar Pradesh State Industrial Development
Corporation Ltd (UPSIDC), the complainant said.
Sharma alleged both the accused insisted on his
depositing the initial amount as they were not having enough
funds and lured him saying he would become half shareholder of
the plot if he pays the amount.
After he paid the money to them, they promised him
that after the allotement of the plot he would have an equal
shareholding and he shall be 50 per cent partner in the
profit.
Sharma said they illegally sold the plot and when he
asked for his money, they told him they have to pay for
another plot in Gurgaon. He added the accused had threatened
him with dire consequences if he asks for his money.
Accepting the submissions of Sharma, the court said
offences under section 420 and 506 IPC are made out against
the accused persons.
"Admittedly, the accused persons had induced the
complainant to part with valuable consideration of the
complainant that they would jointly be purchasing a plot in
UPSIDC which shall be in the name of accused persons. However,
it shall for all purposes be a joint venture of both parties.
"Both accused persons having induced the complainat
made him part with a sum of Rs two lakh and another sum of Rs
2.63 lakh. Further, despite demand, they have not returned the
same and had also sold the plot. Hence, ingredients of section
420 IPC are squarely made out," the court said.
The court also took into consideration the threats by
the accused persons to the complainant.
