New Delhi: A local court on Monday extended by a day the police custody of private detective Anurag Singh, the alleged main conspirator arrested in connection with the attempt to access call details of BJP leader Arun Jaitley.
Other two private detectives Neeraj Nayar and Nitesh Singh were, however, remanded in judicial custody.
The Delhi Police had sought the extension of their custody for three days.
Chief Metropolitan Magistrate Vidya Prakash extended the police custody of Anurag till February 26, saying the police`s plea for his custody is justified "keeping in view the facts and circumstances of the case and the role attributed to accused Anurag Singh who is alleged to be one of the main conspirators involved in the commission of the offences in this case".
The court extended his custody saying it will enable the probe agency to get the entire encrypted data analysed and further interrogate him to unearth the entire conspiracy and also ascertain involvement of other persons in the case.
It, however, declined police`s plea for custody of Neeraj and Nitish. It said after going through the roles attributed to them and the allegations against them, it failed to make out any justifiable ground for their custody.
Delhi Police constable Arvind Dabas, the first to be arrested in the case, is already in judicial custody till March 6.
The police had sought the extension of their custody saying their presence was required for detailed analysis of data found recovered from the material seized in the case.
The prosecution had also submitted that the data available in the material seized by them was mostly in encrypted form and since it is a technical issue, it took time for the police to get it analysed.
Counsel for the accused vehemently opposed the police`s plea for their custody and that the police had earlier also got their custody extended on entirely similar grounds.
Anurag`s counsel Rahul Mishra submitted the police had already made the recoveries it had to at the instance of the accused persons and the grounds for further extension of police custody are "artificial" and "non-justifiable".
