Bajrangi today moved a Delhi court seeking bail in a case
filed against him under the tough law against organized crime
on the ground that the police have failed to file a
chargesheet against him within stipulated 90 days.
Bajrangi, who was arrested under MCOCA (Maharashtra
Control of Organised Crime Act) on November six last year,
claimed he was entitled to bail on the technical ground due to
failure of the investigating agency to chargesheet him till
February five.
Special Judge Madhu Jain put the bail application for
hearing for February 25.
In the application, counsel for Bajrangi Deepak Sharma
contended that under the Criminal Procedure Code, the period
for filing the chargesheet is 90 days but the time limit can
be extended till 180 days in the case of MCOCA only when the
investigating officer seeks permission from a designated
court before the expiry of 90 days.
Sharma claimed Delhi police's Special Cell had got 60
days extension by the court on Februrary 15 which was 10 days
beyond the deadline to file the chargesheet in the case.
Bajrangi, whose real name is Prem Prakash Singh, is also
accused of killing a BJP MLA in Uttar Pradesh in 2005. He was
arrested by a joint police team from Delhi and Uttar Pradesh
on October 29 last on the charge of making an extortion demand
from a city-based businessman from Mumbai.
The gangster, who is allegedly wanted in more than 10
murder cases across the country, along with others, has been
accused of running an organised criminal gang.
