Balakrishnan today said he has left it to his successor to
give opinion on government`s suggestion on revising the
memorandum of procedure which governs the appointment of
judges to the higher courts in the country.
"I left Supreme Court on May 12. I have left it to my
successor in office (Justice S H Kapadia) to give any opinion
on that," Balakrishnan, who today took over as Chairman of
National Human Rights Commission, told reporters here.
He was asked to comment on Law Minister M Veerappa
Moily`s statement yesterday that the revised draft of the
memorandum of procedure has been referred to the CJI.
Moily said the draft of revised memorandum of procedure
was referred to then CJI Balakrishnan for his opinion. But the
Minister did not say whether any response was received.
The procedure of Collegium appointing judges to higher
courts may undergo transformation with the government toying
with the idea of changing the system in the wake of
allegations of lack of transparency and delays.
Moily said the government is "thinking" of making changes
in the appointment procedures as the present practice
(Collegium) does not "fully reflect" the two Supreme Court
judgements, which led to creation of the existing system.
