New Delhi/Ghaziabad: Hours after the Ghaziabad sessions court on Wednesday rejected Nupur Talwar's application for a regular bail, the mother of slain teenager Aarushi moved the Supreme Court for bail.
In the meantime, the Ghaziabad court pronounced May 09 as the date on which murder trial against Talwars will be commenced.
Following the sessions court order, Nupur Talwar will now have to stay in Dasna jail, where she is currently lodged.
The sessions court judge Shyam Lal, while rejecting her bail plea, took serious note of the disrespect shown by the Talwars to the various court summons issued against Nupur Talwar in connection with the case.
The court also agreed to the arguments made by the CBI that releasing Nupur Talwar could have an adverse impact on the progress of its ongoing probe into the case. The CBI had earlier alleged that Nupur Talwar and her husband Rajesh had tried to destroy the evidence in connection with the case.
The Supreme Court is also due to hear the review petition of Nupur Talwar on Friday.
The verdict is a major setback for Nupur, who is accused in the Aarushi-Hemraj double murder case of 2008.
She had been fasting until the Ghaziabad sessions court's verdict came.
Nupur has spent two nights in the Dasna district jail after her bail application was rejected by the special CBI court, which later sent her to judicial custody.
During the previous hearing, the dentist was seen reciting ‘Hanuman Chalisa’ even as the special court heard arguments from her lawyer and the CBI, which strongly opposed her bail plea.
The Additional District and Sessions Judge Shyam Lal had yesterday reserved till today his order on her bail application. However, he gave no specific reasons for reserving the verdict on Nupur's application for a regular bail.
Following a Supreme Court's directive, the dentist surrendered in the special CBI court in Ghaziabad on Monday. However, her bail plea was rejected by the special court after which she was taken into custody and later sent to the Dasna jail.
Nupur Talwar is accused along with her husband Rajesh in the 2008 sensational double murder of her teenage daughter Aarushi and domestic help Hemraj- the high-pfoile case which was later probed by the CBI.
When the proceedings began in the special CBI court, Nupur broke down on hearing the decision of Additional District and Sessions Judge Shyamlal who rejected her interim bail plea and posted the application for regular bail for hearing on Tuesday.
A shattered Nupur, who had the company of her husband and a few relatives in the special CBI court where she was waiting in judicial custody, was taken by women constables in a police van to Dasna jail.
She was later shifted to cell no 13 in the Dsana Jail, where she spent the first night. Her husband Rajesh had earlier spent 50 days in the same jail after his arrest in the case.
On April 27, the Supreme Court had refused to stay the non-bailable warrant issued against Nupur by the Ghaziabad court and directed her to surrender before the special court.
The non-bailable warrant was issued against her by the Ghaziabad court for not appearing for a hearing in the 2008 Aarushi-Hemraj double murder case.
