Paternity suit: Tiwari to challenge HC order

The Delhi High Court ruling said that the leader can be compelled to give blood sample for DNA test in a paternity suit.

Dehra Dun: Congress veteran ND Tiwari would move the Supreme Court against the Delhi High Court ruling which said that the leader can be compelled to give blood sample for DNA test in a paternity suit, his aide said on Friday.
The High Court today scrapped a single judge bench`s September 2011 order that the 86-year-old leader cannot be compelled to give his blood sample.

The court pronounced that police force can also be used if he continues to defy orders to undergo DNA test.

"Tiwari has decided to appeal against the High Court order in the apex court.... This is a judicial process and we respect the court`s order," said Sanjay Joshi, Tiwari`s officer on special duty (OSD).

Joshi said that Tiwari has left for Delhi for further action.
"We have not got the copy of today`s order. What we know is only the media`s version. However, the leader has left for Delhi to take further action," he said.

Asked when the appeal would be filed, he said "after reading the copy of the order and a through discussion with lawyers, we will fix a date for appeal".

Tiwari had refused to give his blood sample to ascertain 32-year-old Rohit Shekhar claim of being his biological son, saying he cannot be forced to do so.
