New Delhi: The Supreme Court on Tuesday refused
to interfere with its order cancelling the bail granted to the
Pune stud owner Hasan Ali Khan in a money laundering case.
"We don`t find any reason to disturb that order
(cancelling the bail)," a bench comprising justices B
Sudershan Reddy and S S Nijjar said.
Khan`s counsel and senior advocate UU Lalit had asked
the bench to reconsider the March 17 order of the vacation
bench which had cited "extraordinary circumstances" of the
case in staying the order of Mumbai Principal Sessions judge ML Tahaliyani on March 11 granting bail to 53-year-old stud
farm owner.
The bench said the vacation bench had passed the order
under extraordinary circumstance and "we want that things
should return to normalcy".
It said it was allowing Khan and giving him liberty to
move an application seeking bail before the Special judge in
Mumbai which will deal with it without being influenced by the
order and observations of the apex court.
The Bench said Enforcement Directorate would also be
at liberty to file an application seeking extension of the
judicial custody of Khan who was sent to jail on expiry of
four days custodial remand granted by the apex court.
However, it agreed to set aside the observations made
by the special judge while rejecting ED`s contention and
granting bail to Khan.
"We make it clear that the observations made by this
court and the special judge will not influence dealing with
Khan`s bail plea and ED`s plea for his remand," the bench
said.
