SC stays Orissa HC order annulling MLA`s election

New Delhi: The Supreme Court today stayed the Orissa High Court order declaring as void the election of independent MLA Ramesh Rout from Athagarh assembly seat in the state.

A Bench comprising Justices H S Bedi and C K Prasad stayed the High Court's June 23 order on the plea of Rout and posted the matter for further hearing after four weeks.

The apex court passed the order on an appeal filed by Rout challenging the High Court's order which had declared his election as null and void and had directed the Election Commission to conduct fresh polls in Athagarh assembly segment in Cuttack district.

The court had on July 9 restrained the EC from issuing notification for fresh polls.

It had also rejected Rout's plea for permission to attend the assembly till the end of the Monsoon Session.

Orissa assembly had cancelled Rout's membership from the House following the High court order.
