Boston: The Winklevoss twins and their
Indian-origin business partner Divya Narendra are not giving
up yet on their legal battle over Facebook against its founder
Mark Zuckerberg, with the trio now pursuing a case in a US
court here alleging he suppressed evidence.
A day after Cameron and Tyler Winklevoss gave up on
taking one lawsuit against Zuckerberg to the US Supreme Court,
the former Olympic rowers and Narendra in a filing at
Massachusetts court alleged Facebook "intentionally or
inadvertently suppressed evidence" during the trio's 2008
settlement proceedings with the site's CEO.
"That part of the case will begin now," Winklevosses'
attorney Tyler Meade said.
Narendra and the Winklevoss brothers claim Zuckerberg
stole their idea for Facebook while the four were students at
Harvard.
The twins yesterday decided not to seek a review of the
ruling that had upheld the USD 65 million cash-and-stock
settlement reached with Zuckerberg in 2008 - the case featured
in Oscar-winning movie 'The Social Network'.
The Massachusetts case concerns the trio's claim that
Zuckerberg had allegedly sent some instant messages while at
Harvard, where he had teamed up with the twins and Narendra on
a novel social networking project ConnectU and this should
have been disclosed during the 2008 settlement process.
In one instant message, Zuckerberg told a friend,
"I'm going to [expletive] them."
In another, referring to the Winklevosses, the Facebook
founder said, "They made a mistake. They asked me to make it
for them. So I'm like delaying it so it won't be ready until
after the Facebook thing comes out."
