Cuttack: Orissa High Court has granted an
interim bail to a lifer to allow him to sit for the Plus II
examinations conducted by the Council of Higher Secondary
Education (CHSE), Odisha starting from tomorrow.
Abinash Behera (21) is now undergoing life
imprisonment in a Sambalpur jail after he was convicted by a
lower court for murder charges.
Behera who had passed the Matriculation examinations
in 2010 in second division while in judicial custody, had
approached the High Court for an interim bail so that he could
write the Plus II examinations.
A Division bench comprising Justices L Mohapatra and B
K Patel allowed the prayer yesterday. In view of the fact
that the boy had pursued the studies in jail and in the
interest of justice, it would be prudent to allow the
petitioner to appear for the examinations?, the High Court
said in its order.
The HC has allowed the interim bail of the boy for
one month so that he can appear for the examinations and
surrender before the lower court after it was over, the boy’s
counsel Prasanna Kumar Nanda said.
During Diwali celebrations in 2008, the boy had toyed
with a licensed pistol of one of his relatives not knowing
that it was loaded and had pressed the trigger accidentally
killing a friend Pushpak Mishra on the spot.
He was taken into custody and latter in December 2011
he was convicted under section 302 of IPC.
