Ashis Nandy booked for 'casteist' comment, BSP demands arrest

Jaipur/New Delhi: Social scientist Ashis Nandy was Saturday booked for linking Dalits, tribals and backward classes to corruption, even as his remarks at the Jaipur Literature Festival drew condemnation from political parties like the BSP and RPI which demanded action against him.

Nandy said he was misunderstood, but Bahujan Samaj Party (BSP) leader Mayawati asked the Rajasthan government to take strong action against him, while Republican Party of India (RPI) chief Ramdas Athawale demanded that Nandy take back his comments.

There were also protests by Scheduled Caste, Scheduled Tribe and Other Backward Classes (OBC) groups outside the festival venue - the Diggi Palace.

Police said a first information report (FIR) was lodged against Nandy under the section 3(1) of the SC/ST Act, which was non-bailable and invited a 10-year jail term. The case was filed by a person identified as Ram Ratan Meena.

Festival director Sanjoy K. Roy was also booked, police said.

A police official at Jaipur's Ashok Nagar police station, where the complaint was lodged, however, told IANS that they would first investigate the incident and then decide on any action.

Amid protests, police helped Nandy, who is in his late 70s, get out of the venue from a back door in the evening, a constable told IANS.

Addressing a press conference in the evening, Nandy told reporters he was misunderstood. "As should be clear, there was neither any intention nor any attempt to hurt any community," he said.

Roy said: "They have clarified their position and have understood that it was a misunderstanding. Controversies are easily created. Please be responsible."

However, the BSP did not accept the clarification.

Talking to media persons in Delhi, Mayawati said Nandy's comments were wrong, baseless and unfortunate.

"Our party demands that the Rajasthan government should register a case and he should be sent to jail," she said.

She said the comments reflected a casteist mindset and were made as part of a thought-out conspiracy to defame people from these communities.

Mayawati said the organisers should also immediately "throw out" Nandy from the festival for his "castiest remarks".

Asked if the party will raise the issue in budget session of parliament, she said the party will take into account the steps taken by the state government, the organisers and the "kind of apology" tendered by Nandy.

Nandy stirred a row at a morning session, titled "Republic of Ideas", when he said: "It will be an undignified and vulgar statement. But the fact is that most of the corrupt come from the OBC, the Scheduled Castes and now increasingly STs. As long as it is the case, the Indian republic will survive."

"I will give an example. The state of least corruption is West Bengal. In the last 100 years, nobody from the backward classes and the SCs and STs have come anywhere near power in West Bengal. It is an absolutely clean state," Nandy said.

At the press conference, Nandy said he meant to endorse fellow panelist Tarun Tejpal's statement that corruption in India was "an equalising force".

In a written statement, he said: "This is not what I meant or what I wanted to say. I endorsed the statement of Tarun Tejpal, editor of Tehelka, that corruption in India is an equalising force. I do believe that a zero corruption society in India will be a despotic society."

"I also said if people like me or Richard Sorabjee (one of the speakers) want to be corrupt, I shall possibly send his son to Harvard giving him a fellowship and he can send my daughter to Oxford. No one will think it to be corruption. Indeed, it will look like supporting talent."

"But when Dalits, tribals and the OBCs are corrupt, it looks very corrupt indeed," he added.

"However, this second corruption equalizes. It gives them access to their entitlements. And so, as long as this equation persists, I have hope for the republic."

Hoping this would end the matter, Nandy said he was sorry if some had misunderstood him. "As should be clear from this statement, there was neither any intention nor any attempt to hurt any community. If anyone is genuinely hurt, even if through misunderstanding, I am sorry about that, too."

The comment given by Ashish Nandy is farthest from truth. Consider the total population of india most are belong to General category and many of them are at the good post in government as well as private sectors. only few candidates are from OBC, SC and ST are at good position at certain extent. If we consider the total corruption in India from differnent sectors then you will find the largest portion of corruption occupy by the General category candidate obviously because they are having majority and corruption is caused throgh the continuous chain process and by a single body. Here single body represents the average of the SCs and STs. Now comes to the Skills and Talent. SCs and STs are having many skills and talents. But because of not having sufficient exposure and poorness lower caste candidates couldn`t come up to the front and not being fully developed due to the such a dirty caste system in indi.a

So far, we have seen the exploitation of ST/SC from Ages. They had been treated as animal. If they are getting some privilage after INDEPENDENCE, PEOPLE LIKE Mr. Nandy will not talerate them.Unknowingly he has started a debate that they are corrupt.Did he meant to say that when SC/ST werenot in the sevice/employment beurocracy was clean particularly immidietly after INDEPENDENCE.

I really supporting to Capt Ajit being in a soldier family, we may be from all section of religion, caste are leaving together without any conflict because no body is ed from donation from govt on the basis of sc/st/obc/minority etc every body in defense are being ed on basis of their own physical standard. Mr Nandy erroneously mentioned perhaps UP state in which so may court cases are pending against CMs and minister from this category. Our veteran may have given such type of chance to these category for best but their efforts gone in vain. I strongly recommend that caste system to be abolished and for reservation only poor to be considered

what else can u expect from a country where freedom of speech is soon going to exist in paper only. filling of F.I.R. is another instance of how intolerant our country is becoming towards any exercise of free speech. no action is taken when sena brothers make offensive statements against north indians and play divisive politics..our criminal law is only set into motion when we want to punish any one for exercising their fundamental rights..

i don`t think freedom of speech in its true form exists in our country anymore..apparently ppl are not allowed to voice any opinion which is politically incorrect..even though i do not agree that corruption comes from any particular community, however, unfortunately, the evidence points to the contrary. look at cases against ex chief ministers Madhu koda or mayawati. The plight of the under privileged community is deplorable and sad but what is more unfortunate is that even those ppl who have had the chance to uplift their community from their plight did nothing to help them. all they ever did was to ramble about reservation policies which clearly has helped no one...It is only deepening the divide in the society especially in the youth...

In the law of Atrocity against SC/ST and section 498A of IPC , the complaint itself is treated as FIR and assumed to be true and cognizible and an arrest is must without warrant.Accused will be immediately remanded to custody upon arrest and a judicial magistrate can grant bail after contest during the process.Draconian laws introduced by Late Indira Gandhi. The prosecution rarely could prove such cases allegation and these two laws are the most misused sections of Indian law if we analyze the success rate of prosecution which is 10-15% as per my observation goes. These two sections contributes maximum revenue to lawyers.

Corruption has no caste or religion. Power brings corruption. Most of the people in politics and bureaucracy who were accused of corruption belong to upper caste. When people belonging to OBC,SC or ST get power they also become corrupt because the system has already been corrupted by the upper caste rulers and bureaucrats . I wonder how Mr Nandy could see only corruption only among lower caste people.

What he told is very true up to an extend. Almost 80% of the SC/ST and OBC come to posts through reservations. And those who come through reservations are the most corrupt,as they are having the post which are not really ment to them.
