Lucknow: The Lucknow Bench of Allahabad High
Court on Monday directed the Director General Of Police, UP to
ensure that all FIRs registered in police stations throughout
the state should specifically mention the age of the accused.
Issuing these directives, while hearing a case relating
to the arrest of a youth in Mohanlalganj area of Lucknow, the
division bench comprising Justice Umanath Singh and Justice
SNH Zaidi said, "We noticed that in the FIR there is no
mention of the age of the alleged detenue, despite several
oral directions to the state counsel that if a specific column
has been provided for that, the same should be mentioned in
the affidavit."
The court provided 10 days time to the state counsel to
file supplementary affidavit and directed to list the matter
thereafter.
A division bench was hearing a habeas corpus petition
filed through telegram sent by one Mithelesh Soni, seeking
safety of her son Sunny alias Ashish from the police.
It was alleged in the telegram that on October 10, 2009,
Mohanlalganj (Lucknow) police had taken her son away at 6 PM.
This telegram was sent to the senior Judge High Court
Lucknow Bench, which was produced before the aforesaid
division bench in the form of habeas corpus petition.
DIG/SSP Lucknow Prem Prakash, in his affidavit (reply)
said that the accused had been arrested in bonafide exercise
of power on October 12, 2009 on account of recovery of a
countrymade pistol of 315 bore and one cartridge of the same
description, while the telegram was sent on October 11, 2009.
The court however said that it was not prima facie
convinced of the DIG's contention that the accused had been
arrested in bonafide exercise of power, as the telegram is
dated October 11, 2009, whereas accused has been shown to have
been arrested on October 12, 2009.
