Bombay HC judge's appointment challenged after 14 years

Mumbai: The Bombay High Court on Wednesday appointed State advocate general Ravi Kadam as amicus curie to assist the court in a petition challenging appointment of Justice J N Patel as a high court judge.

Justice Patel was elevated to the High Court on March 11, 1996. Before that he was the judge of special TADA court which was set up for the trial of 1993 Mumbai serial blasts case.

The petition challenging Patel's appointment to High Court has been filed by practising advocate and former Sessions Judge V P Patil.

The petitioner alleged that Justice Patel did not complete ten years as a judge in lower courts, and as per the Constitution, a lower court judge must serve for ten years to be eligible for elevation.

The hearing will be held next week.
