New Delhi: A court here has acquitted Delhi
Congress MLA Talvinder Singh Marwah and six others of charges
of rioting and injuring policemen during campaigning in Lok
Sabha elections in 1999.
"All witnesses have stated that the accused (Marwah) was
delivering provocative speeches and the crowd started shouting
slogans but nowhere have they stated as what the speaker was
uttering," Additional Sessions Judge S C Rajan said.
The court absolved Marwah, MLA from Jangpura, and others
saying that the prosecution failed to prove as to how he had
instigated the crowd to attack the police party.
It also noted that the prosecution witnesses could not
name those who had pelted stones and caused injuries to Delhi
police Constables Ved Prakash and Joginder during the rioting
on September 6, 1999 at Sriniwaspuri in south Delhi.
A case was registered against Marwah and others alleging
that he had led a crowd of nearly 700 people who had broken
window panes of Sun light police post here. They also pelted
stones which left two policemen injured.
According to prosecution, armed with rods and swords,
the crowd was protesting the preventive arrest of a Congress
party workers on September two, 1999 for allegedly creating
nuisance after consuming liquor during campaigning in the 13th
Lok Sabha elections.
Out of the 15 prosecution witnesses, a Delhi police
constable, who had sustained injuries in the incident, had
turned hostile.
