New Delhi: A Delhi Court on Tuesday adjourned the
hearing in the September 13, 2008 serial blasts cases here as
police are yet to complete the investigation of a suspect
arrested on February 1.
Additional Sessions Judge Santosh Snehi Mann, who was to
hear arguments on charges to be framed against the accused,
listed the matter for further proceeding on February 23.
The court's decision to adjourn the matter came after
Additional Public Prosecutor Rajiv Mohan submitted that one of
the absconding accused, Shahzad, has been arrested by the UP
Police and handed over to Delhi police.
The investigation pertaining to his role in the cases is
yet to be completed, Mohan said while requesting the court to
adjourn the matter.
"It is submitted by APP that supplementary chargesheet
would be filed after interrogation of accused (Shahzad) and
investigation qua his disclosure in the cases. Accused is
alleged to be involved in all the cases. He is required to
face trial with the co-accused before the court. In the
circumstances and the submissions of the APP, the matter is
adjourned," the court said.
Meanwhile, the court took exception to the absence of the
investigating officer ACP Sanjiv Yadav during the proceeding
and stop short of issuing a coercive order after the APP
submitted that he would ensure his presence on the next date
of hearing.
The court said the investigating officer should be
present with the APP as he was required to assist during the
proceedings.
