Delhi HC seeks response from CBI, govt on anti-Sikh riots cases

New Delhi: The Delhi High Court today sought a response from CBI and city government on a PIL seeking appointment of a Special Public Prosecutor to handle the 1984 anti-Sikh riots cases on the line Gujarat riots cases.

A bench headed by Chief Justice A P Shah issued notices asking them to file their response when an NGO alleged prosecuting agencies, including CBI, are in "collusion" with "influential" accused in these cases trying to protect them.

The court asked them to file their response by February 3, when the matter will be taken up for further hearing.

The court passed the order on a PIL filed by an NGO 'Nov-84 Carnage Justice Committee' seeking its direction to appoint special law officers and to monitor the cases on a day-to-day basis in view of the delay in its hearing.

"The state machinery, including the prosecuting agency, instead of fairly doing their job, have been openly aiding, helping and obliging the accused. The manner in which CBI has thrown all legal norms to the wind and helping the accused in open court is in itself sufficient for intervention of this court in order to ensure fair and impartial trial in the case," the NGO said in its petition.

"The whole approach of CBI is to somehow shield the guilty and enable them to get away unpunished as the accused persons are very powerful and enjoy political as well as money power," it further said.
