New Delhi: Madhya Pradesh government today
accused the Centre of misleading the Supreme Court on the
issue of canal work for Indira Sagar and Omkareshwar projects.
The state government took strong objection to the
affidavit filed by the Ministry of Environment and Forest
(MoEF) in which it said the project cannot be allowed as
Command Area Development (CAD) Plan has not been submitted to it by the authorities concerned with the project.
"An incorrect affidavit has been filed by the MoEF to
mislead the court," senior advocate T R Andhyarujina,
appearing for Madhya Pradesh government, submitted before a
Bench comprising Chief Justice K G Balakrishnan and Justices J
M Panchal and B S Chauhan.
He said CAD plan was submitted to the MoEF in September
1992 and August 1993 by Madhya Pradesh government and a wrong impression has been given by the Ministry.
The court was hearing the appeal filed by the state
government against the order of the Madhya Pradesh High Court restraining it from further acquisition of land and carrying out of excavation and canal work for Indira Sagar and
Omkareshwar projects.
The High Court had passed the order on a petition filed
by Narmada Bachao Andolan activist Medha Patkar.
Patkar, who made brief arguments, said the NBA was not
against the project but was concerned that the relief and
rehabilitation package for the project-affected families
should not be compromised with.
