Patna: The Patna High Court on Tuesday asked the
Election Commission, state and Central governments, and the
state legislative council to convene a meeting within two
weeks to resolve the issue pertaining to anomalies in the
retirement of MLCs.
A division bench comprising Chief Justice Dipak Misra and
Justice S K Singh, while hearing a PIL filed by an NGO, also
directed the authorities to file a report relating to the
outcome of the meeting, to be held in Delhi, by February 8.
The court's directive came on Chhaya Sarkar's PIL, where
it was argued that according to the provisions of the
Constitution, one-third of the members of the Upper House
(Legislative Council) should retire every two years and
simultaneous elections should be held to fill vacancies in the
House.
"But the election takes place any time in Bihar flouting
the provisions of the Constitution. It is held in an arbitrary
manner," advocate M P Gupta, who appeared on behalf of the
NGO, pleaded.
